Terms of Service
These terms explain custom portrait orders, secure file handling, proof restrictions, delivery and artwork rights.
1. Agreement to These Terms
These Terms of Service govern purchases from Face2Face Creations. By submitting an order, selecting the required acceptance checkbox or using the service, you agree to the version of these Terms presented at checkout.
2. Custom Artwork Services
Face2Face Creations creates custom digital artwork from customer-supplied photographs. Unless expressly stated in writing, purchases include digital files only; printing, framing and shipping are not included. Custom artwork involves artistic judgment, and colors, backgrounds, composition and fine details may be adjusted to create the selected style while preserving the subject’s recognizable identity.
3. Customer Materials & Permissions
You confirm that you own, or have permission to use, every photograph and other material you submit, and that you have permission from any recognizable person shown. You remain responsible for the legality and accuracy of submitted materials.
Secure photo and project-file handling
Customer photographs and project files must be submitted through the designated order-linked upload system. Production upload and proof-delivery links may be private, access-controlled and time-limited. Face2Face Creations will use reasonable administrative, technical and organizational safeguards, including encrypted transfer and access limited to authorized order-fulfillment purposes; however, no internet transmission or storage system can be guaranteed completely secure.
Do not submit files through public links or unapproved channels. Keep your own copy of every source photograph. Files may be retained as reasonably necessary to fulfill the order, provide support, maintain transaction records, comply with law or resolve disputes, and then deleted under applicable retention practices. Customer artwork will not be posted publicly for marketing or portfolio use without the applicable permission.
4. Orders, Payment & Production
Prices, scope and custom charges will be disclosed before work begins. Payment authorizes Face2Face Creations to begin the commissioned work. Applicable taxes may be added where required. Stated turnaround times are estimates and may change for complex restoration, added subjects, source-photo limitations or circumstances outside reasonable control.
5. Proofs, Previews & Unauthorized Use
Proofs are for review only
Face2Face Creations may provide digital proofs, previews, drafts, mockups, watermarked images, low-resolution images or other preliminary versions of custom artwork (“Proofs”) solely so the customer may review the artwork, request permitted revisions or provide approval. Proofs are not purchased or licensed artwork. Access to a Proof does not constitute final delivery or grant ownership of, or a license to use, the Proof or underlying artwork.
Prohibited actions before purchase
Until full payment, you may not:
- download, save, screenshot, screen-record, copy, capture, extract or reproduce a Proof except as expressly authorized;
- print, post, upload, publish, display, transmit, email, distribute or share a Proof;
- use a Proof on social media, a website, marketplace, advertisement or printed product;
- remove, crop, conceal, obscure or alter a watermark, logo, copyright notice, protective overlay, metadata or security feature;
- sell, license, sublicense, transfer or provide a Proof to another person;
- trace, reproduce, commission, generate or create a derivative, imitation or substantially similar work from a Proof; or
- use artificial intelligence, image processing, enhancement or other technology to remove protections, reconstruct, enhance, extract or reproduce the underlying artwork.
No license before payment
All rights remain with Face2Face Creations until full payment. Proof access grants only a limited, temporary, nontransferable and revocable right to view the Proof for approval or revision.
Liquidated damages
You acknowledge that knowing and material unauthorized use of a Proof may cause losses that are difficult to determine accurately in advance, including the value of unpaid artwork and rights, creative and investigative resources, loss of control over unreleased artwork, unauthorized distribution and impairment of commercial value. To the extent permitted by applicable law, you and Face2Face Creations agree that $500 per affected artwork is a reasonable advance estimate of those losses as liquidated damages, not a penalty or punishment. Face2Face Creations will not receive duplicative recovery for the same injury.
Payment of damages does not purchase the artwork or grant a license. Upon notice, you must stop the unauthorized use and delete or remove all unauthorized copies.
6. Intellectual Property & Purchased Artwork
Face2Face Creations retains copyright in the artwork and underlying creative treatment. After full payment, you receive a non-exclusive license to display and print the final delivered artwork for personal use. You may not resell, sublicense, distribute, claim authorship of or commercially reproduce the artwork without written permission. The license applies only to the final delivered work—not rejected concepts, drafts or Proofs.
7. Portfolio & Promotional Use
Face2Face Creations will follow the portfolio or promotional permission selected or otherwise agreed to by the customer. Submission of a photograph does not by itself grant broader promotional rights.
8. Revisions, Approval & Final Delivery
Included revisions must remain within the original order scope. New source photos, major concept changes or added subjects may require an additional fee. Review Proofs carefully. Final approval authorizes delivery; additional changes after approval or delivery may incur a fee. Finished artwork is delivered electronically, and customers are responsible for downloading and safely backing up delivered files.
9. Cancellations, Refunds & Satisfaction
Because each portrait is custom-made, cancellation and refund eligibility depends on work completed. No refund is available after final approval or delivery except where required by law. If dissatisfied, contact us promptly with specific feedback and we will make a reasonable good-faith effort to resolve concerns within the agreed scope. 10. Acceptable Content & Right to Refuse
Face2Face Creations may decline or cancel requests involving unlawful, threatening, harassing, hateful, exploitative, obscene, deceptive, infringing or otherwise inappropriate material or abusive conduct. Any unearned payment will be handled according to applicable law and the work completed.
11. Digital Files & Customer Responsibility
Customers are responsible for keeping backup copies. Color, crop and appearance may vary among screens, printers, media and third-party vendors. Face2Face Creations does not guarantee third-party printing results.
12. Limitation of Liability
To the fullest extent permitted by law, Face2Face Creations is not liable for indirect, incidental, special, consequential or punitive damages, and total liability is limited to the amount paid for the order giving rise to the claim. Nothing in these Terms excludes liability that applicable law does not permit to be excluded.
13. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
14. Severability & Changes
If any provision is found invalid or unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will continue in effect. The last-updated date identifies the current version; the version accepted when an order is placed applies to that transaction.
15. Terms Acceptance & Transaction Records
Before an order may be submitted, the customer must affirmatively accept these Terms of Service, including the Proof & Artwork Use restrictions. Failure to select the required Terms checkbox must prevent submission.
The production order system will retain an acceptance record associated with the transaction, including the order number, customer identifier or email, accepted Terms version, date and time of acceptance, and other appropriate transaction and technical records maintained in accordance with applicable privacy practices and law.
